The BOT (Build-Operate-Transfer) & Infrastructure Projects Practice Group has advised various government, public enterprises and private corporations on legal aspects of infrastructure projects. With respect to infrastructure projects, we currently act as legal counsel to Taiwan's Ministry of Transport & Communications on the US$18 billion Taiwan High-speed Rail project (the most expensive & largest BOT project in Taiwan to date). The railway system, scheduled for completion in 2005, allows rail travel between Taipei and Kaohsiung in less than 3 hours.

In our practice, we have cooperated with specialists in various fields such as engineers, contractors, consultants, foreign experts, sub-contractors, financiers, project owners and the government. We provide legal services which include advice and guidance on: Tender guidelines; Bidding techniques; Drafting & presentation of Project proposals; Contractual negotiations; Undertakings associated with infrastructure projects; Land matters; Tax issues; Structured-financing; and Dispute resolution & Litigation.

For nearly a decade, we have devoted significant resources to building the size and expertise of this Practice Group. Since its establishment, this group's practice has branched out into other areas associated with BOT.

We are also active in the growing global trend towards privatization, and public-private partnerships in infrastructure development. Some projects that we have advised on include: Kingmen Ocean Crossing bridge project, CKS Airport-MRT link, private sector bids for National Scenic Resorts and incinerator construction & operation.

Apart from acting for the Ministry of Transport & Communications, we also advise other government agencies such as Taiwan Power Co. (a public enterprise), National Expressway Engineering Bureau, Bureau of Foreign Trade and Bureau of MRT. We have good working experience with various government agencies.

In addition, our services extend to the following matters:

  • Advised the local government on the construction and operation of incinerator.

  • Acted for private sector participants in the development of a marine biology museum and service facilities.

  • Advised the municipal government on cable-car planning.

  • Advised a public-listed company on technical alliance in construction of a waste incinerator costing NT$8 billion.

  • Providing legal consultation to a public-listed company on construction of a heat-recycling plant costing NT$4 billion.
